Civil Liability Insurance - A Summary

This is a unique policy designed by Perkins Slade Limited specifically for sports governing bodies, like the BCU/SCA. The main features of the policy are as follows.

Public Liability
Legal liability for third party accidental injury or property damage arising out of the activities of the governing body, its affiliated clubs or members. More details here (rft document) or here (pdf document)

Products Liability
Legal liability for third party accidental injury or property damage arising out of any product (including defective containers) sold or supplied by the governing body, its affiliated clubs or members.

Directors' and Officers' Liability
Legal liability protection to directors and/or officials of the governing body and its affiliated clubs, arising out of their executive and management responsibilities.

Libel and Slander
Legal liability protection to officials for defamatory comments made, either verbally or in print.

Professional Indemnity
Legal liability for injury or financial loss, which the claimant alleges has occurred due to incorrect advice, given by those within the governing body and its affiliated clubs who provide instruction or coaching.

Employers Liability (Where Applicable)
Legal liability for injury to a person arising out of and in the course of their employment by the governing body and/or its affiliated clubs.

IMPORTANT

Claims Made Wording

The policy is on a 'claims made' wording. This means that, irrespective of when an 'incident' occurred, it is the policy in force at the time of the claim being made which will respond. The cover also provides 'run off' protection for those who retire or cease to participate in sport (in whatever capacity) but who subsequently face legal action.

Extensions

1. Member to member liability.
2. Worldwide cover * see below.
3. Liability for damage to leased or rented premises.
4. Indemnity to any Principal to a contract or agreement (for example, a landowner where an event is held).
5. All activities (whether sporting or social) of the governing body or its affiliated clubs are insured.
6. Indemnity to directors, officials, employees, members, labour only sub-contractors, and voluntary helpers.
7. Contingent Motor Third Party protection for the governing body and its affiliated clubs.
8. Cyber liability.

* The policy provides cover in USA/Canada for individual coaches visiting, teams visiting and playing, and individual members of associations visiting in connection with association activities. It is standard for a UK insurer (your insurer is no exception) to limit their cover for USA/Canada related risks, mainly due to the highly litigious society and the level of damages awarded.
